I understand that by registering for and attending How to Become Your Own Nutrition Advocate (the “workshop”) hosted by Your Healthy Happy Journey LLC (“YHHJ”), I am agreeing to all of the terms of this Participant Publicity Waiver and Release (this “Agreement”). 

I hereby irrevocably and unconditionally agree for myself, my personal representatives, my heirs, next-of-kin, insurers, successors, and assigns, as follows: 

PHOTOGRAPHY AND VIDEOGRAPHY 

I expressly grant my permission to be photographed, audiotaped or videotaped during this 6-week workshop and for said photographs, video or audio content to be used by the YHHJ team as it deems fit. I understand that the Workshop shall own all intellectual property rights, if any, arising in connection therewith, and I further agree and acknowledge that I shall not receive (or be entitled to receive) any compensation from the YHHJ workshop for any such usage. 

PAYMENT 

Workshop participation requires payment. Registration received without payment will not be processed. 

Registrants may pay by credit/debit card. Absolutely no refunds will be made for any reason. Paid registrations may be transferred to another party by emailing [email protected] with the name and email of the person you wish to transfer the ticket to. The deadline to request workshop transfers is 48 hours prior to the first live zoom call. 

DISCLAIMERS 

To the fullest extent permitted by law, YHHJ expressly disclaim any liability for any direct, indirect or consequential loss or damage incurred by you or others in connection during this workshop, including without limitation any liability for any accidents, delays, injuries, harm, loss, damage, death, lost profits, personal or business interruptions, misapplication of information, physical or mental disease, condition or issue, physical, mental, emotional, or spiritual injury or harm, loss of income or revenue, loss of business, loss of profits, loss of contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted time and for any other loss or damage of any kind, however and whether caused by negligence, breach of contract, or otherwise, even if foreseeable. YHHJ, and the speakers, exhibitors or sponsors are not medical, legal, financial or other professionals, or if they are, during the terms of this Workshop and related material(s), they are not offering our professional services and you expressly agree they are not acting in any professional capacity, including medical, legal, financial or otherwise during the term of this Workshop. This Workshop is for educational and entertainment purposes only. None of this Workshop or its related material(s) should be construed as medical, legal, financial advice.   

RELEASE FROM LIABILITY  

I fully and forever release and discharge YHHJ its affiliates, successors, assigns, agents, consultants, representatives, volunteers, and licensees, the venue, speakers, exhibitors, sponsors and all others involved in this Workshop from any and all injuries (including death), losses, damages, claims (including negligence claims), demands, lawsuits, expenses, and any other liability of any kind, of or to me, my property, or any other person, directly or indirectly arising out of or in connection with my participation in this Workshop, whether such claims arise from negligence, breach of any duty imposed by law, mistake or error in judgment, or from any other cause, and whether such claims are known or unknown, or suspected or unsuspected (all such claims, demands, losses, liabilities, damages and causes of action are referred to collectively herein as the “Released Claims”)  

ASSUMPTION OF RISKS 

By registering for and attending this Workshop, you assume all the risk of participation in this Workshop, as well as any subsequent actions you choose to take as a result of the influence, information or educational materials provided to you by YHHJ and any speakers, exhibitors or sponsors. I understand I am solely responsible for my personal safety and the protection of my personal property during this Workshop.  

INDEMNIFICATION AND HOLD HARMLESS 

You agree at all times to indemnify, hold harmless and reimburse YHHJ its affiliates, successors, assigns, agents, consultants, representatives, and licensees, speakers, exhibitors, sponsors and all others involved in this Workshop, from and against any and all claims, causes of action, damages, liabilities, costs and expenses, including legal fees and expenses, arising out of or related to this Event.  

SEVERABILITY 

If any term or provision of this Agreement is invalid, illegal or unenforceable in any jurisdiction, such invalidity, illegality or unenforceability shall not affect any other term or provision of this Agreement or invalidate or render unenforceable such term or provision in any other jurisdiction. 

GOVERNING LAW 

Any dispute arising out of this Agreement or actions taking place during this Event shall be governed by and construed in accordance with the laws of the State of Arizona without giving effect to any choice or conflict of law provision or rule (whether of the State of Arizona or any other jurisdiction). 

ACKNOWLEDGEMENT OF UNDERSTANDING 

I have read this Agreement in full and understand its terms, including that I am giving up substantial rights, including my right to sue. I acknowledge that by registering for this Workshop and attending I voluntarily agree to these terms and the unconditional release of all liability to the greatest extent allowed by law.
